Handphone confiscated how arh?

Hi....this is quite embarrassing for me, but I'm worried enough to ask for opinions.
That night I was at a pub with this friend who kinda showed a dirty face everytime I said I needed to go home. So I give my friend face lor.... stayed for as late as I dared to, before we left (which was unfortunately too late).
After dropping my friend off, before I hit the main road, I SMSed my wife to explain to her why I was late and asked her not to internally latch the main door yet (we have an agreement that I have to be home before this happens each night - an agreement which she takes very seriously). I SMSed her because she won't answer my the calls if I'm late.
Problem is that there was a traffic policeman was hiding there near the road exit from her apartment. He saw me SMSing and confiscated my phone. I tried to explain to him vaguely that I had urgent family commitments but he just wouldn't hear of it. It was difficult for me to elaborate on the truth too much, so I just kept saying "urgent family commitment", which I now think sounded like lame BS.
I read the police website and it says that first offenders will have to attend court to receive a penalty of 12 points + max. $1000 and/or 6 months jail (handphone forfeiture and driving ban are options). However, my "experienced" friends tell me that its usually 12 points + a few hundred bucks + 6~12 months ban from driving.
Does anyone know in reality, what the penalty for first-time offenders usually is, please? And will they return our handphones? (I hope they don't auction off the phones? Cos I have some very personal data in its memory card...).
I'm still nervously waiting for the official summons letter. If you can, please provide some information for comfort because I'm really quite nervous now..... -

I can imagine how anxious you are though, and I hope that your penalty won't be as serious as what it sounds. Be careful next time! -

Oh dear, gentlerock...........I'm sorry about your predicament and doubly sorry that I am of no help 'cos I don't know either. But I just hope it won't erupt to something nasty.
You said personal data in the memory. I hope it is not "hurtful". Anyways, don't be nervous or worry too much or even worry about something that hasn't happened. Que sera sera.........friend.

freestyle, I cannot deny lah....if we dare to do something, then we should dare to stand up to the consequences. By the way, they confiscate your handphone so that they can trace your call timings.
If I get away with this lightly enough, I promise to drive carefully from now on, won't secretly go to pubs again, and will even contribute to NKF again or anything lah. Just please don't take away my licence 'cos I really need it for my job.....my job (and thus my mostgages, etc) is at risk.
After its all over, I'll come back and update you guys.....provided Changi prison has internet access.

Anyway, I hope you dont lose your driving license.. although the most you would get is a fine I guess.. its nots as if they caught you drunk driving

you wont be sentenced to jail for using a hp while driving.
it will probably be a small fine and confiscation of the hp.
btw if you are troubled by this why dont you consult a lawyer? -

I don't think you'll get jailed , but err... worst scenario could be short-term suspension of license
My sympathies , it really is tough luck especially if your livelihood is dependent on travelling around. -
since he is a first-time offender i doubt there is even a suspension.
just act remorseful in court and ask for leniency. dont argue, plead guilty and the court will be forgiving.
afterall they are not out to ruin your life.
you can also through the lawyer explain why you were calling your wife. this is a good mitigating factor. -
Don't argue with the law....
say you have realised that you have done wrong and promised that you will not do it again.
Getting lawyer or argueing will only get you into more trouble.
Like they say...... don't gamble against the casino, they have more reserves than you. -

Won't jail u but be prepared to be suspended from driving for a few mths.
A fren got fined 1k, 12points + suspended from driving for 8mths.
Think there's a slightly different penalty for cars going straight & turning.. -

It was clear that I was in the wrong, so I don't think I should do anything to blow it out of proportion. So I probably won't opt for lawyer or MP. Just face the music and hope for the best lah.
Yeah, I also heard from 3-4 friends who know about this (either they or their friends have gotten it before)....and they unanimously said that I'll have to attend court, get 12 demerit points and will probably be suspended for driving for a few months (6-12 months).
But then again, I've also heard of two recent cases where they just were fined and given demerit points, without suspension or anything else. Now there's some hope!

But seriously, I wish you well, gentlerock. Just hope the punishment will not be too heavy. Best bet is not to argue but can explain that these "material" were taken while as a tourist? Stay calm, yah. Cross the bridge only when you come to it. Now anxiety also no use, yah.
