It'd always been eligible as a "vegetable" but FDA was going to tighten it up. That's what Congress is blocking.
Ironically, FDA are also the same people going after raw milk and farm-to-table products.

don't they have other more important things to take care off like their economy or the general health of their populance instead of worrying about inconsequential things like whether something that is a fruit is called a vegetable?
